Rubistas.com.br
on November 10, 2009
Last night I made available www.rubistas.com.br, a translation fork of the original Rubyists.eu. I thought it’s a great website because of its simplicity on the approach to group together communities and make them easier to find for everyone.
But, I was careless. According to the Creative Commons License I failed to add proper attribution to Rock & Code and Rubyists.EU. So, Rock & Code contacted me. We talked and I agreed to cease and desist both my fork at github and the website.
I was told that the way I wrote the original blog post in Portuguese (already removed) did upset some of the European collaborators. Specially the part that would translate as “… it is nothing more than a Google Maps mashup.” Again, the intention was never to be negative, quite contrary, it was to pinpoint the fact that it would not be difficult for people to collaborate.
So, rubistas.com.br will remain down. I have no plans for it for the time being.

very sensitive people.
My name is Mariela and I am one of legal associates of Rock & Code a.k.a “sensitive jerks.” In the true Dutch spirit, I would like to quote the famous Dutch football player Johan Cruyff. He once said that everything is a matter of space and time. Probably such is the case with the latest blog post of Fabio.
Before I turn into the devil’s advocate, I would like to clarify a few facts. The Rubyists.EU initiative is a corporately branded project that was initiated by Rock & Code, which is a Dutch company. This initiative is part of our (evil) corporate social responsibility program. There is ample evidentiary support, which can confirm this fact. It is solely oriented to the European Ruby/Rails community for the moment. Due to many factors, including time, space, our own limited resources, our skills, our potential, and primarily our sensitivity, we have not made it worldwide. As we have already explained to Fabio, we were more than flattered a person of such influence and prestige was interested in our project. Yet, we started off on the wrong foot. Fabio himself already explained that he was careless about the very nature of the project. He was not aware, as he presumably failed to read, that this is not a truly open-source project, that it is a corporate initiative (really evil), and that the license and our own terms and conditions, which we have clearly stated in writing from the very onset of the Rubyists.EU initiative, stipulate that before anybody starts doing anything, he or she must contact us, as we are looking forward to a constructive dialogue, before we engage in a fruitful collaboration. Fabio himself can confirm that he never contacted us and he simply forked the source code and took the text from our website (the fact that he failed to give Rock & Code and the Rubyists.EU collaborators any credit was the least of his worries). Since we have outlined the proper channels of interaction and we have set the rules, we considered his actions to be unacceptable. Thus, we were forced to contact him. Fabio himself can confirm that he was not treated badly. On the contrary, we were really friendly and understanding. Had I been in my usual mood, Fabio would booking a flight to Amsterdam so that we can meet in the district court of Amsterdam (truly hostile). We discussed lots of issues with Fabio and we arrived to an understanding that the rubistas.com.br is not going to die. On the contrary, it is going to be even more grandiose and it would encompass the entire Latin America, rather than just Brazil. Fabio is supposed to be in charge of this initiative later in time (we really treated him badly). It is a pity that he failed to inform you of this. The reason why we asked him not to work on this project for the moment is that we want to give it a try in Europe first and see how it goes. If it works fine, then the initiative can be extended to other continents. If it does not work, it is only Rock & Code’s fault. In that context, I would like to state that the temporary halt of this initiative in other continents is not due to some kind of European superiority or corporate cruelty. Indeed, two of the members of the Rock & Code team (including the very creator and initiator of the Rubyists.EU initiative), are from Buenos Aires, Argentina. But again, Fabio can elaborate on that himself.
If you want to send me any kind of hate mail or all your love, you can contact me at mariela [at] rock-n-code [dot] com. I will try to answer all the e-mails that I receive from you, but again, do not count on my doing so on Friday night and during the weekend.
Again, the Rubyists.EU initiative is not reinventing the wheel. As a very favorite song of mine goes, it is only rock’n’roll but hey, I (Rock & Code and Europe) like it!
Greetings,
Mariela
Just by looking at your defensive post, it just seems that you're antagonizing against Fabio even more just to save your own public image, even though it seems he's just been complying to your cease and desist. Compare this to the response Fabio has given which seems to be to the point with no hard feelings, simply outlining that you guys apparently did serve him with a cease and desist. If you use such harsh measures, you shouldn't be surprised to get responses like this from us. In particular because you mention that you're already familiar with Fabio, and yet still chose to serve him with a cease and desist.
If you don't want your project to be forked then don't put it on github. Simple like that. Arguments such as "corporately branded project ... (that) we have not made worldwide " are ridiculous. Sorry. You shouldn't be working with Ruby and Rails.
And yes, it is nothing more than a Google Maps mashup, sensitive Rock & Code folks.
Evil? It`s look like very stupid...
very stupid people...
I would be very happy to see the Brazilian ruby community starting a "simple google maps mashup rails project" to host the information about local rubists on rubistas.com.br.
And you should be "Community Evil". The project should be distributed under GPL!
